Legislation Introduced to Lower Your Litigation Costs

| Tort Reform & Legal Climate

As you know, it is hard to separate the legal climate from the business climate, as the legal environment greatly impacts the state’s competitiveness for jobs, business investment and growth. North Carolina’s legal system should not encourage unnecessary litigation that adds costs and prevents employers from creating jobs.

One of the priorities on the 2015 JOBS Agenda is establishing measures to protect your company against costly violations. The Property Protection Act (S433, H405) protects property owners against those who gain access to non-public areas and engage in activities that go beyond the permission given by the owner. Additionally, it creates a $5,000-per-day penalty for the violation, similar to civil penalties under the Unfair and Deceptive Trade Practices Act. This will help guard against corporate espionage, organized retail theft and other employment fraud activity North Carolina businesses face.
